What Is Mahr? Meaning in Islam
Mahr is the financial entitlement a husband owes his wife through marriage, often described as a bridal gift or dower. Also called haq mehr or sadaq, it belongs to the wife rather than her family. Its amount, form and payment terms should be understood clearly and recorded in the marriage contract.
Arabic and pronunciation
مهر
mahr
Literal meaning: Mahr means the bridal gift or dower owed to the wife.
In the Qur'an and Sunnah
Qur'an 4:4 directs that women be given their bridal gifts and recognises a woman’s voluntary decision to remit some of what is hers. The emphasis on willing consent matters: relatives or a spouse should not pressure her to surrender the entitlement. Mahr is not a purchase price paid for a person.
Qur'an 4:20 warns against taking back what has been given to a wife in the circumstances it addresses. Sahih Muslim 1425 records a marriage account involving limited material means and teaching from the Qur’an. Scholars discuss its contractual implications in detail; it should not be used to dismiss a woman’s agreed financial rights or assume any informal promise is sufficient.
How it works in practice
Couples should discuss mahr before the nikah, including the exact amount or item, currency, payment date and whether any portion is deferred. Distinguish money already received from a promise to pay later. If gold is agreed, record enough detail to identify the obligation, such as weight and purity, rather than relying on an ambiguous description of jewellery.
Mahr belongs to the wife, who should have control over what she receives. It is separate from wedding expenses, gifts to relatives and any cultural dowry arrangements. A family contribution to catering does not automatically discharge it. Keep receipts and an accessible copy of the contract, and make sure both spouses understand any translation before signing.
In the UK, do not assume that every mahr clause will be enforced automatically by a civil court. Its legal treatment depends on the facts and applicable law, and a religious-only marriage may create additional difficulties. In Pakistan, complete the relevant nikah-nama entries accurately, distinguishing prompt and deferred amounts and recording any payment already made.
In Gulf countries, court registration and local personal status rules may affect how mahr is recorded, claimed and enforced. In France and Germany, civil courts may assess a mahr agreement through applicable domestic and cross-border rules. Where spouses have different nationalities or assets abroad, seek independent legal advice rather than relying on a sample contract from another country.
Common questions
- Is mahr the same as a dowry?
- Not in the common sense of wealth provided by the bride’s family. Mahr is owed by the husband to the wife. Because English usage varies, spell out the actual entitlement and payment direction rather than relying on the word “dowry” alone in discussions or documents.
- Can mahr be paid later?
- An agreement may provide for deferred payment, subject to the relevant religious and legal rules. State exactly when it becomes due and avoid assuming everyone shares the same understanding. Deferral should not be treated as cancellation or as a reason to omit the obligation from the paperwork.
- Can a wife give up her mahr?
- A voluntary decision is different from a waiver obtained through pressure. She should understand the amount, consequences and alternatives before agreeing. If the request arises during conflict, separation or threats, obtain independent advice before signing a release or accepting someone else’s interpretation of her rights.
- What if the agreed mahr is unpaid?
- Preserve the contract, messages and evidence of payments. Seek advice about the religious obligation and available legal remedies in the relevant country. Do not assume that an unpaid amount automatically ends the marriage, or that a spouse’s denial settles a disputed claim.
